Liability and Publicity Release Form for 904 Day Contest
In consideration of being selected as a prize winner in the Visit Jacksonville promotion (the “Promotion”), I, the undersigned, hereby agree to the following terms:
1. ELIGIBILITY AFFIRMATION
I affirm that I am a legal resident of the 50 United States, the District of Columbia or Puerto Rico, am 21 years of age or older, and fully comply with all eligibility requirements outlined in the official rules of the Promotion. I certify that all information I have provided is true and accurate.
2. RELEASE OF LIABILITY
I, on behalf of myself, my heirs, executors, and assigns, hereby release and hold harmless Visit Jacksonville, its affiliates, partners, sponsors, officers, directors, employees, agents, and advertising and promotion agencies (collectively, the “Released Parties”) from any and all liability for any injuries, losses, or damages of any kind, including but not limited to personal injury, death, or property damage, arising from or in connection with my participation in the Promotion or acceptance, use, or misuse of the prize.
3. PUBLICITY CONSENT
I grant to Visit Jacksonville and its authorized representatives the irrevocable right to use my name, likeness, voice, biographical information, photographs, video, or statements for advertising, publicity, and promotional purposes in any and all media, now or hereafter known, throughout the world in perpetuity, without further compensation or notice, except where prohibited by law.
4. PRIZE CONDITIONS
I understand that I must complete this Affidavit of Eligibility and Liability/Publicity Release within five (5) business days of being notified. Failure to do so will result in the forfeiture of the prize, and an alternate winner may be selected at Visit Jacksonville’s sole discretion. I understand that prizes will be awarded within approximately seven (7) days after Visit Jacksonville receives this fully executed release.
5. GOVERNING LAW
This Release shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.
